A Circuit Court ruling granted the same privacy rights to email users as to telephone users. Littler Mendelson shareholder and Chair of the Privacy and Data Protection Practice Group Phil Gordon commented on the ruling's implications in the workplace, advising employers to "be aware that the Sixth Court did not state that a workplace-monitoring policy will always defeat an employee"s expectation of privacy."
