Shareholder Tim Rybacki is relocating his practice to Nashville from Littler’s Houston office, while Roger Scruggs recently joined as an associate from King & Ballow. The addition of Rybacki and Scruggs signals the sustained growth of Littler’s Nashville office.

About Timothy A. Rybacki
Rybacki represents employers across all areas of labor and employment law, with a primary emphasis on matters involving labor-management relations, union avoidance, unfair competition, theft of trade secrets, and non-competition matters. He regularly practices in federal and state trial and appellate courts and before the National Labor Relations Board (NLRB) and Equal Employment Opportunity Commission (EEOC). He also has successfully litigated many labor arbitrations for clients that are parties to collective bargaining agreements. In the unfair competition arena, Rybacki has obtained permanent and temporary injunctions and helped guide clients to substantial monetary recoveries related to competitors’ thefts of trade secrets and breaches of non-competition and non-solicitation agreements. Most recently, he was part of a litigation team that obtained a $12.5 million verdict and stipulated judgments of $28.5 million in a complex trade secrets case in the financial industry. Additionally, he helped guide a firm client to high-profile victories against the Service Employees International Union (SEIU) in the Texas First Court of Appeals and Texas Supreme Court.
Rybacki is a frequent author and speaker on developments in labor law, competition and trade secret issues, with works appearing in such publications as the Texas Journal of Business Law. In law school, he received the American Bar Association and Bloomberg BNA Award for Excellence in the Study of Labor and Employment Law, received the W. Richard Smith Award for Excellence in Legal Writing and Research Writing, received the Dean’s Award for Outstanding Academic Achievement in Wage and Hour Law by Emory University School of Law, and served as Executive Managing Editor of the Emory International Law Review. Prior to receiving his J.D. from Emory University School of Law, Rybacki received his B.B.A. from the University of Texas’ McCombs School of Business.
About Roger D. Scruggs
Scruggs’ practice includes representation of employers in a variety of areas, including wage and hour, discrimination, harassment, retaliation, independent contractor status, background checks and religious and disability accommodation. In litigation, he has represented employers in federal and state court against both single and multi-plaintiff lawsuits, with a focus on wage and hour class and collective actions. He has also defended employers before various federal state agencies, including the EEOC and the Tennessee Human Rights Commission.
In 2009 and 2010, he was the recipient of the Dean’s Distinguished Service Award, and in 2010, he also received the CALI Award for Excellence in Law and Medicine by the Center for Computer-Assisted Legal Instruction. He received his J.D. from the University of Memphis Cecil C. Humphreys School of Law and his B.A. from the University of Georgia.
