Erin Train is a cutting-edge litigator at the forefront of several evolving areas of law in both New York State and throughout the country. She utilizes her skills and extensive experience working as a defense attorney “to play devil’s advocate” when honing arguments made on behalf of the clients she represents, often resulting in dismissals at the early stages of litigation. 

Not only a zealous advocate, Erin also invests time in understanding the driving force behind clients’ business needs to effectively counsel employers covering every size – from Fortunate 500 companies to small, family-run businesses. 

Erin focuses a large portion of her practice on complex class and collective matters and has had significant success doing so. Nonetheless, she has significant experience handling all stages of litigation, including discovery, depositions, arbitrations, mediations, and municipal trials in state and federal court, as well as handling matters before administrative agencies.

Selected Matters

  • Dismissal of putative class and collective action for alleged unpaid overtime claims first in federal court and subsequently in state court after the complaint was refiled after dismissal at the federal level
  • Failure to prosecute dismissal after opposing counsel read moving papers seeking dismissal of uncompensated time
  • Dismissals of multiple lawsuits alleging failure-to-accommodate religious beliefs, including several multiplaintiff lawsuits
