Independent Contractors, Joint Employers and the Unintended Employment Relationship

The U.S. Department of Labor (DOL) recently issued new guidance narrowing the definition of an independent contractor, while the National Labor Relations Board’s (NLRB) new Browning Ferris decision expanded the definition of a joint employer. Taken together, these two developments may mean that your company is now the “employer” of both 1099 workers and the employees of subcontractors or franchisees. This event will help you understand the DOL’s new guidance on independent contractors and the NLRB’s new joint employer standards, and learn to avoid “red flag” practices that could increase your company’s risk.
