Critical Update: Oregon Requires Changes to Harassment Policies and Settlement, Separation, and Severance Agreements Effective October 1, 2020

This will be a comprehensive discussion of Oregon's Workplace Fairness Act provisions that go into effect on October 1, 2020. The new law requires that all employers doing business in Oregon distribute a harassment policy with specific provisions; restricts confidentiality, non-disparagement, and no rehire provisions in settlement and separation agreement; impacts golden parachutes for executives found to have engaged in harassment; and significantly lengthens the statute of limitations for employment discrimination claims from one to five years. In addition to discussing the rules, we will provide proposed language for policies and settlement and separation agreements, outline strategies for implementation, and address frequently asked questions with practical solutions.
