Classifying Companions and Live-Ins as Exempt Again? Yes, U.S. DOL Has Proposed That Change for the FLSA!
As you may have heard by now, there is BIG NEWS on the federal wage and hour front!
On July 2, 2025, U.S. DOL published proposed regulations that – if finalized – would permit third-party agency employers to classify companion and live-in caregivers as exempt from the federal FLSA’s overtime requirements.
Note, however, that these rules are just proposals at this point – not finalized – and they do not replace or supersede more protective state laws that may still require caregivers to be classified as nonexempt and overtime eligible.
